Apple Beats In Q2 2013, Posts First YOY Earnings Decline Since 2003: $43.6B In Revenue, $9.5B In Profit, EPS Of $10.09

apple-stockApple has been the subject of plenty of financial scrutiny (perhaps even more so than usual) recently, and now all that speculation has come to a head. The Cupertino company has just released its fiscal Q2 2013 earnings -- it reported $43.6 billion in revenue (up from $39.2 billion in the year-ago quarter) along with $9.5 billion in quarterly net profit, which works out to earnings of $10.09 per share.

TSX steady as lackluster data, earnings drag

By John Tilak

TORONTO (Reuters) - Canada's main stock index closed little changed on Tuesday as sluggish economic data from China, Germany and the United States revived concerns about the global recovery.

Lackluster earnings reports from some Canadian companies also weighed down investor sentiment.

The latest Purchasing Managers' Indexes for the euro area showed business activity in Germany shrank for the first time in five months in April, while China's April HSBC flash PMI fell. Also, U.S. manufacturing grew at its most sluggish pace in six months as domestic demand dried up.

The resource-heavy index, which is sensitive to global growth trends because of their impact on commodity prices, was up for the fourth straight session, but is down about 3 percent on the year.

"The market?s got this rally going, but we don't think we're out of the woods yet," said Robert McWhirter, president and portfolio manager at Selective Asset Management. "There is probably another 2 to 3 months of pullback to occur."

The Toronto Stock Exchange's S&P/TSX composite index <.gsptse> closed up 0.26 of a point at 12,090.94.

Last week, the index posted its second-biggest weekly decline of the year, triggered by a rout in commodity prices, including the biggest single-day drop in gold prices ever.

"Commodities are under pressure," said Kevin Headland, director, portfolio advisory group, at Manulife Asset Management. "The Asian growth story that we're seeing is slower than we're used to."

Headland does not see too many catalysts for commodity prices, but still expects the index to end the year higher.

A 1 percent fall in the price of gold and a decline in Teck Resources Ltd hurt some material stocks.

Teck was down 1.6 percent at C$25.60 after the miner reported a 40 percent fall in first-quarter adjusted profit due to lower coal prices. The company said economic uncertainty might affect prices and shipments.

Goldcorp Inc fell 3 percent to C$28.44.

Among energy companies, EnCana Corp lost 1.7 percent to C$18.96 after the natural gas producer reported a 25 percent fall in first-quarter operating profit due to hedging losses.

Rogers Communications Inc declined 3.5 percent, a day after it reported first-quarter results.

TransAlta Corp was down 2.6 percent at C$13.70 after the power generation company reported a first-quarter loss, hurt in part by a one-time charge related to pension funding obligations.

Ohio gas prices shoot back up

COLUMBUS, Ohio (AP) -- The big drop in gas prices in Ohio didn't last long.

A gallon of regular gas in Ohio was listed at an average of about $3.65 in Monday's survey from auto club AAA, the Oil Price Information Service and Wright Express. That's 27 cents higher than last Monday's average of $3.38.

The Ohio price this week is 13 cents higher than the national average of $3.52.

The state average is about a dime lower than this time last month, and 6 cents lower than at the same time in 2012.

Analysts say they typically expect to see a spike in gas prices as the summer driving season approaches.

The lowest average price in the state Monday was about $3.58 in Youngstown and Warren.

China rushes relief after Sichuan quake kills 186

LUSHAN, China (AP) ? Luo Shiqiang sat near chunks of concrete, bricks and a ripped orange sofa and told how his grandfather was just returning from feeding chickens when their house collapsed and crushed him to death in this weekend's powerful earthquake in southwestern China.

"We lost everything in such a short time," the 20-year-old college student said Sunday. He said his cousin also was injured in the collapse, but that other members of his family were spared because they were out working in the fields of hard-hit Longmen village in Lushan county.

Saturday's earthquake in Sichuan province killed at least 186 people, injured more than 11,000 and left nearly two dozen missing, mostly in the rural communities around Ya'an city, along the same fault line where a devastating quake to the north killed more than 90,000 people in Sichuan and neighboring areas five years ago in one of China's worst natural disasters.

The Lushan and Baoxing counties hardest-hit on Saturday had escaped the worst of the damage in the 2008 quake, and residents there said they benefited little from the region's rebuilding after the disaster, with no special reinforcements made or new evacuation procedures introduced in their remote communities.

Luo said he wished more had been done to make his community's buildings quake-resistant. "Maybe the country's leaders really wanted to help us, but when it comes to the lower levels the officials don't carry it out," he said.

Relief teams flew in helicopters and dynamited through landslides Sunday to reach some of the most isolated communities, where rescuers in orange overalls led sniffer dogs through piles of brick, concrete and wood debris to search for survivors.

Many residents complained that although emergency teams were quick to carry away bodies and search for survivors, they had so far done little to distribute aid. "No water, no shelter," read a hand-written sign held up by children on a roadside in Longmen.

"I was working in the field when I heard the explosions of the earthquake, and I turned around and saw my house simply flatten in front of me," said Fu Qiuyue, a 70-year-old rapeseed farmer in Longmen.

Fu sat with her husband, Ren Dehua, in a makeshift shelter of logs and a plastic sheet on a patch of grass near where a helicopter had parked to reach their community of terraced grain and vegetable fields. She said the collapse of the house had crushed eight pigs to death. "It was the scariest sound I have ever heard," she said.

The quake ? measured by China's earthquake administration at magnitude 7.0 and by the U.S. Geological Survey at 6.6 ? struck shortly after 8 a.m. on Saturday. Tens of thousands of people moved into tents or cars, unable to return home or too afraid to go back as aftershocks continued to jolt the region.

The quake killed at least 186 people, left 21 missing and injured 11,393, the official Xinhua News Agency quoted the provincial emergency command center as saying.

As in most natural disasters, the government mobilized thousands of soldiers and others, sending excavators and other heavy machinery as well as tents, blankets and other emergency supplies. Two soldiers died after their vehicle slid off a road and rolled down a cliff, state media reported.

The Chinese Red Cross said it had deployed relief teams with supplies of food, water, medicine and rescue equipment to the disaster areas.

Lushan, where the quake struck, lies where the fertile Sichuan plain meets foothills that eventually rise to the Tibetan plateau and sits atop the Longmenshan fault, where the 2008 quake struck.

The seat of Lushan county has been turned into a large refugee camp, with tents set up on open spaces, and volunteers doling out noodles and boxed meals to survivors from stalls and the backs of vans.

A large van with a convertible side served as a mobile bank with an ATM, military medical trucks provided X-rays for people with minor injuries, and military doctors administered basic first aid, applying iodine solution to cuts and examining bruises.

Patients with minor ailments were lying in tents in the yard of the local hospital, which was wrecked by the quake, with the most severely injured patients sent to the provincial capital. With a limited water supply and buildings inaccessible, sanitation is a problem for the survivors.

One of the patients receiving care in the hospital's yard was the son of odd-job laborer Zhou Lin, 22. The baby boy was born a day before the quake struck. Zhou said he was relieved that his newborn son and wife were safe and healthy but was worried about his 60-year-old father and other relatives who have been unreachable in Baoxing.

"I can't get through on the phone, so I don't know what's going on there and they don't know if we are all right," he said.

Every so often, an aftershock struck, shaking windows of buildings and sending murmurs through the crowds.

(AP) ? A team led by a nurseryman from northern Michigan and his sons has raced against time for two decades, snipping branches from some of the world's biggest and most durable trees with plans to produce clones that could restore ancient forests and help fight climate change.

Now comes the most ambitious phase of the quest: getting the new trees into the ground.

Ceremonial plantings of two dozen clones from California's mighty coastal redwoods will take place Monday in seven nations: Australia, New Zealand, Great Britain, Ireland, Canada, Germany and the U.S.

Although measuring just 18-inches tall, the laboratory-produced trees are genetic duplicates of three giants that were cut down in northern California more than a century ago. Remarkably, shoots still emerge from the stumps, including one known as the Fieldbrook Stump near McKinleyville, which measures 35 feet in diameter. It's believed to be about 4,000 years old. The tree was about 40 stories high before it was felled.

"This is a first step toward mass production," said David Milarch, co-founder of Archangel Ancient Tree Archive, a nonprofit group spearheading the project. "We need to reforest the planet; it's imperative. To do that, it just makes sense to use the largest, oldest, most iconic trees that ever lived."

Milarch and his sons Jared and Jake, who have a family-owned nursery in the village of Copemish, Mich., became concerned about the condition of the world's forests in the 1990s. They began crisscrossing the U.S. in search of "champion" trees that have lived hundreds or even thousands of years, convinced that superior genes enabled them to outlast others of their species. Scientific opinion varies on whether that's true, with skeptics saying the survivors may simply have been lucky.

The Archangel leaders say they're out to prove the doubters wrong. They've developed several methods of producing genetic copies from cuttings, including placing branch tips less than an inch long in baby food jars containing nutrients and hormones. The specimens are cultivated in labs until large enough to be planted.

In recent years, they have focused on towering sequoias and redwoods, considering them best suited to absorb massive volumes of carbon dioxide, the greenhouse gas primarily responsible for climate change.

"If we get enough of these trees out there, we'll make a difference," said Jared Milarch, the group's executive director.

Archangel has an inventory of several thousand clones in various stages of growth that were taken from more than 70 redwoods and giant sequoias. NASA engineer Steve Craft, who helped arrange for David Milarch to address an agency gathering, said research shows that those species hold much more carbon than other varieties.

The challenge is to find places to put the trees, people to nurture them and money to continue the project, Jared Milarch said. The group is funded through donations and doesn't charge for its clones.

"A lot of trees will be planted by a lot of groups on Arbor Day, but 90 percent of them will die," David Milarch said. "It's a feel-good thing. You can't plant trees and walk away and expect them to take care of themselves."

The recipients of Archangel redwoods have pledged to care for them properly, he said. The first planting of about 250 took place in December on a ranch near Port Orford, Ore. Others will be planted during Earth Day observances Monday at the College of Marin in Kentwood, Calif., and in parks and private estates in the other six countries.

"I know the trees will thrive here," said Tom Burke, landscape manager at the College of Marin. "We've had redwoods in this area since God planted them."

OK Glass, RIP Privacy: The Democratization Of Surveillance

guy-glassHow's this for synchronicity: Google Glass started shipping on the same week that CISPA passed the House, 3DRobotics unveiled their new site, and 4chan and Reddit pored over surveillance photos trying to crowdsource the identity of the Boston bombers. Cameras on phones. Cameras on drones. Cameras on glasses. Cameras atop stores, in ATMs, on the street, on lapels, up high in the sky. Modern cars log detailed data their manufacturers can access if they so desire. Oh, and "if you carry a phone, your location is being recorded every minute of every day." In 1999, Sun CEO Scott McNealy said: "You have zero privacy anyway. Get over it." Sadly, that sounds more prophetic every week.

Boston Marathon bombing moves from solidarity to partisan politics

Partisanship was absent in the days following the Boston Marathon bombing. Now, political issues are entering into the discussion, including gun control, immigration, and national security.

Democrats and Republicans declared a truce of sorts Saturday ? at least in their respective weekend radio addresses, both of which focused on the Boston Marathon bombing. Usually those venues are used to attempt to score political points on things like the economy, immigration, and gun control.

"Through days that would test even the sturdiest of souls, Boston's spirit remains undaunted ? America's spirit remains undimmed," President Obama said in his regular weekly address. "Our faith in each other, our love for this country, our common creed that cuts across whatever superficial differences we may have ? that's what makes us strong."

"I have no doubt the city of Boston and its surrounding communities will continue to respond in the same proud and heroic way that they have thus far, and their fellow Americans will be right there with them every step of the way,? Obama said just hours after the second alleged attacker had been captured, ending a day of violent confrontations in which the first alleged attacker was killed in a shootout with police.

Speaking on behalf of the GOP, US Sen. Tim Scott of South Carolina, echoed the same theme.

"We will stand strong, we will stand united, and we will stand together for Boston,"?Sen. Scott said. ?The greatness of America is not seen during times of prosperity, but is crystallized by how we respond to challenges."

"The leaders of this country will do everything in our power to bring justice for the families and the communities impacted," he said. "Our freedom is our most precious possession ? any effort to take it away will only strengthen our determination."

Through the long, dark week that ended with the capture of Dzhokhar Tsarnaev in Watertown, Mass. Friday evening, the nation?s political leaders had hung together in their support of stunned Bostonians and the law enforcement agencies, medical personnel, and just plain citizens who worked heroically to respond, then as federal, state, and local officials scrambled to find the perpetrators and prevent any other attack that might have been planned.

Mitt Romney, the former Massachusetts governor who had been soundly defeated in the presidential election by Obama, praised the President?s speech at a memorial service in Boston honoring the victims of the multiple blasts that killed three people and injured more than 170 ? a terrorist attack that brought a lock-down of Boston and surrounding towns.

?I thought the president gave a superb address to the people of this city and the state and the nation,? Mr. Romney said on CNN. ?It was an inspiring day.?

But any event can be turned to political purposes, and the Boston Marathon bombing is no exception.

With news that brothers Tamerlan and Dzhokhar Tsarnaev had an arsenal that included pistols and a rifle as well as home-made bombs, gun control was sure to come up.

Mass. police: Bombing suspect may not have car

WATERTOWN, Mass. (AP) ? Massachusetts State Police say the at-large Boston Marathon bombing suspect fled on foot and may not have a car.

Col. Timothy Alben says police have no indication Dzhokhar Tsarnaev (JOH'-kahr tsahr-NY'-ev) has a vehicle.

Massachusetts Gov. Deval (deh-VAL') Patrick says mass transit service is resuming in Boston even though Tsarnaev is still on the lam.

Authorities in Boston had suspended all mass transit and warned close to 1 million people in the entire city and some of its suburbs to stay indoors. The other suspect, his brother, died in a desperate getaway attempt.

The brothers are suspects in Monday's marathon bombings, which killed three people and wounded more than 180 others. The men are also suspected of killing a Massachusetts Institute of Technology police officer in his vehicle late Thursday.

Desiccate Scrubs Personal Data from iTunes and Amazon-Bought Tunes

Windows: You may already know that when you buy music from iTunes, Amazon, and other digital music stores, some personal information like your account ID or username are embedded in the track metadata. Desiccate is a free Windows utility that scrubs them clean.

Desiccate is simple to use: as long as you have .NET Framework 2.0 or higher installed, you can launch it directly from the link below and run it against your files (it's deployed as a server-side app hosted by the developer). When you do run it, you're presented with three checkboxes that represent different types of data you can remove.

PRIV and COMM data are often used by Amazon and COMM and UFID are used by iTunes, but keep in mind that COMM will remove any comments from your music file's tags?including those you may have added yourself. You can even tell the app to take a test run against your files to log what it would remove before you commit to the changes. As always, make sure you have backups of your files before using an app like this: the dev notes that if your music files are corrupted, running any tool like this may corrupt them further. When I ran it however, it cleaned my music files with no issues at all.

It's worth noting that the personal info embedded in each track is how music retailers combat piracy: if the file appears on a file sharing network, it can be traced back to the person who uploaded it. Unfortunately, it could also put you in a bad position if your computer is lost or stolen, or if your computer is compromised and someone takes the opportunity to snag all of your music. Use your judgement, and it should go without saying: don't do anything illegal and/or stupid.

Tallahassee, Fla. -- Florida lawmakers are trying to change the way the state awards alimony.

They say the new changes will give families more certainty.

Many of them believe one spouse should not have to pay the other for the rest of their lifetime after a divorce. This new bill could make that happen.

Many Floridians have stories of divorce within their families, and several state representatives shared theirs Thursday evening.

"It shows that this bill isn't anti-woman or this bill isn't a republican or a democrat issue, this bill is a pro-family, pro-kid piece of legislation and I'm really proud to be a part of it," Rep. Ritch Workman, (R) Melbourne, FL, said.

The house approved the reform Bill 85 to 31. Rep. Ritch Workman was a sponsor of it in the house.

"85 members of the Florida house voted, it's bi-partisan, it's actually super majority, makes the bill relatively veto proof which is exciting for me," Workman said.

The bill does give judges full discretion to make a decision on what they see fit for alimony. If the governor signs the legislation, it will take affect July 1, 2013.
The bill let's ex-spouses petition a judge to lower or end alimony payments upon retirement.

It also gets rid of permanent alimony, makes it harder to get alimony in short-term marriages and sets limits on the percentages of monthly income that could be awarded.

Representative Stafford dissented the bill and expressed her concerns.

Cynthia Stafford
"It gives an unfair advantage or protects the person paying and is unfair to the person receiving alimony," Rep. Cynthia Stafford, (D) Miami, FL, said.

Either way, the bill now goes to Governor Rick Scott's desk.

(AP) ? "American Idol" contestant Lazaro Arbos won the hearts of viewers not just because of his singing, but because of his personal story.

The 22-year-old from Florida suffers from a severe stutter that disappears while he's performing. Though the Cuban-born performer acknowledges that his speech impediment got him attention, he doesn't think it won him votes.

"I think that I had really good songs. I had bad songs, but I had really good ones (too) and when I messed up, they stopped voting for me," he said in an interview Monday.

He went on to say that if he didn't stutter, he thinks he would have lasted longer on the show.

Abros placed sixth on "Idol," which airs Wednesdays and Thursdays on Fox. He was voted off last week and was the last male competitor this season.

He said he bonded closely with the remaining girls on the show and he's interested in tuning in this week to see who gets sent home.

"I'm excited to see what songs they pick and how they do and who goes home next, as bad as that sounds," he said, smiling.

Abros will hit the road when the "Idol" contestants launch a tour this summer.

Strategies for Negotiating More Rationally

In past articles, we have highlighted a variety of psychological biases that affect negotiators, many of which spring from a reliance on intuition.

Of course, negotiators are not always affected by bias; we often think systematically and clearly at the bargaining table.

Most negotiators believe they are capable of distinguishing between situations in which they can safely rely on intuition from those that require more careful thought ? but often they are wrong.

? In fact, most of us trust our intuition more than evidence suggests that we should.

Intuition and Reality in Negotiation

To explain why individuals don?t always think rationally or logically, Keith Stanovich of the University of Toronto and Richard F. West of James Madison University have distinguished between what they call System 1 and System 2 thought.

? System 1 thought describes our intuition: quick, automatic, effortless, and influenced by emotion.
? By comparison, System 2 thought is slower, more conscious, effortful and logical.

When you are carefully considering options, you are using System 2 thinking.

When you are simply acting on intuition, you are using System 1 thinking.

We can all think of instances in which we acted rashly, relying on System 1 thoughts and emotions, as well as times when we carefully evaluated a situation using System 2 logic.

System 1 Versus System 2 Logic in Negotiations

Unfortunately, most people ? especially busy managers and executives ? fall back on System 1 thinking during their negotiations.

? Reliance on intuition increases when a situation is complex and negotiators reach a state of cognitive overload. At such times, our ability to process information is pushed to the limit and we naturally shift away from System 2 thought toward System 1 thought.

Clearly, a complete System 2 thought process is not necessary for every managerial decision or for every small negotiation you may face.

? When you?re negotiating with your coworkers over where to go for lunch, when you?re setting deadlines for low-priority tasks, or when you?re informally discussing items that you plan to revisit later in more detail, System 1 thought will be sufficient.

Taking the time to logically reason through every decision can be costly, even leading to decision paralysis. However, we encourage you to engage in System 2 thought during your most important negotiations.

Four Strategies for More Rational Negotiations

The following strategies will help you guard against falling back on your intuition during times of stress and indecision in negotiation.

Strategy 1: Make a System 2 List.

The first step in negotiating more rationally is to identify situations that call for extra vigilance.

? Periodically, perhaps once per month, make a list of important upcoming negotiations that you think might require System 2 thought. Such negotiations might concern lots of money, complex issues, multiple parties, key strategic partners, or a new direction for your firm.

When you carefully prepare for particular negotiations, you are setting yourself up to engage in System 2 thought in situations where it is required. You also should schedule negotiations to best engage in System 2 thinking.

? If you?re a night owl, for example, avoid meeting with an important client first thing in the morning. In addition, this strategy will remind you to actively participate in any necessary pre-negotiation discussions that could affect the agenda.

Strategy 2: Don?t Let Time Pressure Affect Your Decisions

As we have noted, intuitive System 1 thought often takes over when negotiators are facing intense time pressure. Awareness of this tendency should lead you to make key adjustments to your negotiations.

? Instead of scheduling to negotiate over a short lunch, set aside an entire morning ? remember, you?ve already decided that these talks are important. If someone catches you off guard and launches into discussions on the fly, ask to reschedule the conversation for a later time or date.

Real estate agents and other intermediaries are famous for ?forcing? people to negotiate, make commitments, or respond to requests under immense time pressure. Too many people fall prey to this tactic, for fear of losing the deal or offending the other party.

? But, in most cases, there is little reason you should feel guilty about postponing your negotiation or decision. Unless someone has given you specific, credible information that time truly is of the essence, avoid succumbing to pressure tactics.

Strategy 3: Partition the Negotiation Across Multiple Sessions

Human beings have a natural desire for closure. As a result, most of us seek to reach an agreement or settlement as quickly as possible. But keep in mind that completing an entire negotiation in one session is typically unnecessary ? and, in fact, sometimes impossible.

Even when you?re well prepared, a negotiation that is the slightest bit complex will raise new information, unforeseen issues, and tactics that you did not anticipate.

In negotiation, patience often generates significant dividends.

? To avoid falling back on System 1 thinking, structure a process that allows you to rethink or re-strategize. You might schedule breaks every hour or two; these intervals will give you time to evaluate and organize unexpected information ? as well as your thoughts.

When you expect talks to be especially intricate, consider negotiating over multiple days. You might exchange preliminary information by e-mail on Day 1, have initial discussions over the phone on Day 2, and meet in person on Days 3 and 4 for substantive negotiations. By giving yourself time to think things through, you?ll be in a better position to apply System 2 thought throughout the negotiation process.

Strategy 4: Adopt an Outsider Lens

Why are we typically unaware of our own biases in negotiations, yet at the same time, capable of accurately pinpointing the biases that influence others?

Psychologists Daniel Kahneman of Princeton University and Daniel Lovallo of the Australian Graduate School of Management have argued that we make decisions using two different lenses: the insider lens and the outsider lens.

? A negotiator typically uses an insider lens for making judgments when deeply immersed in a particular context or situation; the insider relies on intuitive System 1 thinking.
? By contrast, the typical negotiator adopts an outsider lens when removed or detached from a particular situation; the outsider uses rational, System 2 thinking.

The insider focuses only on the current situation, while the outsider is better at integrating information across multiple episodes ? in particular, other people?s successes and failures.

Obviously, for our most important negotiations, the outsider lens is preferable.

Unfortunately, however, the outsider lens is rarely the default option when we are facing major negotiation or are embroiled in conflict.

A negotiator might well be aware that it takes six to 12 weeks to move from an initial sales call to a legally binding agreement. Yet, when a new prospect comes along, she may nonetheless believe that she can close the deal within three weeks.

Furthermore, the overconfidence bias suggests that negotiators are likely to continue to be overly confident about their odds of success despite being proven wrong in the past. In other words, most of us fail to learn from experience.

When deciding whether to start a new business, entrepreneurs should use their outside lens to critically and comprehensively analyze negotiations over land, construction, hiring, and so on.

Yet overconfidence remains the norm; in a study by Arnold Cooper of Perdue University, Carolyn Woo of Notre Dame University, and Wiliam Dunkelberg of Temple University,

? More than 80% of entrepreneurs estimated their personal chances of success to be 70% or higher;
? One-third of them described their success as certain.

If these entrepreneurs adapted the outsider lens, as Kahneman and Lovallo suggest, they easily would find out that the five year survival rate for new businesses is only about 33%.

Many intelligent people stake their reputations, large sums of money, and years of their lives on intuition and overconfidence.

The strong urge to view the world ? and ourselves ? in a positive light can powerfully affect our decision making in negotiation.

How can you make sure the outsider view is represented at your most important negotiations?

? First, during preparation for a key negotiation, consider hiring a true outsider, whether an expert within your firm, a consultant with unique experience, or a trusted friend. When your deal is complex or emotionally charged, others will identify factors that you have ignored, weight negative information more appropriately, and maintain an objective view of the ways that you cannot.

? If you are not willing or able to bring in an outsider, becoming an outsider yourself by assessing the situation as if you were not immersed in it. This strategy might require you to recall when someone else was faced with a similar situation or to collect data on what you should rationally expect. In addition, ask yourself this simple question: If someone I cared about asked me for my opinion in a negotiation such as this, what advice would I give?

Together, these strategies should help you identify when to incorporate careful, reasoned analysis into your negotiation judgments.

We realize that our recommendations run counter to the implicit trust and confidence that many of us have in our intuition.

However, the data is clear: with the use of intuition comes the potential for significant psychological biases that lead to irrationality. By accepting this gift, you can learn to overcome bias and think more rationally during your most important negotiations.

The Hobbit will be first movie to support UltraViolet in New Zealand and Australia

Peter Jackson's homeland hasn't been too hot on UltraViolet until now, despite the cross-platform library tool's growing popularity in the US and UK. That'll change with The Hobbit: An Unexpected Journey, which is set to launch on DVD and Blu-ray in New Zealand on May 1st and will allow both Kiwis and Aussies to purchase the movie on disc and then watch it on PC, Mac, iOS, Android and hopefully even Xbox via a redemption code and a Flixster account in the cloud -- with no DIY required. In wider UV-related news, the technology is also scheduled to reach France and Germany by the end of Q3 of this year, which should a few names to the 12 million account holders around the world who've already used UltraViolet to watch 9,000 different titles.

Shield Genie

Some parental control tools are designed to actively engage with your kids, for example, letting them know when a website is blocked, and why. Others serve to monitor the children's activity, with or without their knowledge. Shield Genie falls squarely in the latter camp, but it's not as stealthy as most of its competitors. On the plus side, its $149.95 price tag is a one-time cost, not a subscription.

Global Aware Technologies, publisher of Shield Genie, was recently spun out of CTH Technologies, a company that provides security, compliance, and business intelligence for enterprises. The company's principals pointed out that CTH has been around for 13 years and has thousands of customers, so while Shield Genie is very new, it relies on "proven CTH technology."

Odd Interface
I don't doubt that Shield Genie relies on proven technology, but its user interface would have fit right in thirteen years ago. As you can see in the slideshow images, it has a blocky, dated style. In addition, it doesn't always follow the normal conventions for standard controls. For example, radio buttons are normally used for mutually exclusive settings, where only one can be chosen. Checkboxes are used for settings that can be turned on and off independently. Shield Genie frequently uses checkboxes for mutually exclusive settings, which may confuse some users.

Its HTML-based help system is also a bit off. Under Windows XP, Internet Explorer blocked the "scripts and ActiveX controls" that make the help system work. I had to click Allow Blocked Content and then confirm my choice, every time I opened the help. In addition, the help system seems to be a version or two behind the product I tested, with some configuration settings visibly absent (and therefore unexplained) in its screenshots.

Incomplete Stealth
When you install Shield Genie, it offers Stealth Mode as an option; you can also enable or disable that mode later on. However, it's not very stealthy. In stealth mode it does refrain from displaying a desktop icon, and it doesn't show up in the Start Menu or in Add/Remove Programs, but it's clearly visible in Task Manager, it shows up in the list of startup programs, and it adds not one but three icons in Control Panel.

Spector Pro 2011 installs in full stealth mode, with nothing visible in Task Manager or the Startup programs. So do PC Pandora 7.0 and WebWatcher. For all three of these products, you launch the local configuration client by pressing a special key combination and entering your password. The password-entry box doesn't offer any clue as to what program is requesting the password.

The only way to launch Shield Genie is by using its Control Panel icons; you can't launch it by finding the executable in Windows Explorer because it prevents access. The program does include an option to hide the control panel icons, but watch out: if you set it to both hide the product and hide the Control Panel icons you won't be able to launch the configuration window at all. Shield Genie will continue to send alerts and reports, but the only way to regain control of the product's configuration is to contact tech support for help.

Alert Configuration
During the setup process you configure communication for Shield Genie's alert system. You must enter an email address and a phone number for texts; you can also add a second email address. You also have to supply a web-based email account that Shield Genie will use to send these alerts, along with the password for that account.

I was leery of giving the program my email password at first. Tech support explained that there's no remote component at all to Shield Genie, so the information would never leave my test system. Had I still been concerned at this point, I could have created a new webmail account just for this purpose. WebWatcher, Spector Pro, and PC Pandora all send email alerts, but not texts.

By Phil Elderkin
LOS ANGELES

Jonathan Winters is a comedian for all seasons!

Winters talent is elastic, stretching across a wide variety of situations and characters. Often he supplies his own sound effects, ranging from gurgling fountains to bouncing Ping-Pong balls.

And he?ll tell you frankly that no one knows exactly what makes people laugh.

?There is no stock or easy answer to that question,? says Winters, who is currently resident humorist on ABC?s ?Good Morning, America. ?Humor is real all right, only at the same time it?s intangible. It has no definition of its own because so much of it just happens.

?What works for me might not work for other comedians and vice versa,? said the man who so admires the precise timing of Laurel and Hardy. ?I do satire because it?s something I like, something I feel comfortable with, and something that turns me on. But if I tried to be a stand-up comic and just deliver clever lines from a stage, I don?t think I could make it.?

On Jan. 21, 1976, as part of America?s bicentennial celebration, the NBC television network will present a one-hour comedy special tracing the 200-year-old roots of American humor and starring Jonathan Winters.

Starting out at Plymouth Rock and working south and west on the same paths traveled by our America's pioneers, Winters will portray famous people, both real and legendary, as they tell about the things they found humorous.

Viewers can catch this ex-marine as an Indian chief, colonist, blacksmith, Virginiia
farmer, Betsy Ross, and Ben Franklin.

Winters seems to have an honest appreciation for the multiple problems and barriers facing most of today?s young comedians.

?All of these new kids are in trouble because there are so few places ? so few small clubs left on either the East or West Coasts ? where they can go to polish their craft.

?Years ago radio was a tremendous help. It was a training ground for all kinds of actors and actresses just getting started. But when television came in it changed the role of radio. Now the opportunity to learn the business from behind a studio microphone simply isn't there.

?Nobody gets a show in Las Vegas today without having first made it big somewhere else,? he continued. ?You've got to have a name. The competition is terrific, and the critics are tough. They can bury you. Barriers like this stop a lot of kids before their talent has a chance to mature. And the few who make it often can?t stand the pace.

?As a performer, I look at a man?s head as his own private movie camera,? Jonathan said. ?His eyes are the lenses and his ears are the most fantastic piece of sound equipment in the world. That also makes him the editor of anything he watches or hears. And that?s why timing and clarity are so important to an actor. If he misses on either one, he?s lost his audience to the refrigerator.

?In fact, staying on top usually is tougher than getting there. For example, TV rarely forgives a bad show and it almost never gives a second chance to young comedians who don?t make it their first time out. It?s entirely possible for a kid to blow his entire career within the space of an hour.?

Winters says the big thing in television production today is to keep costs down and force the director to get his show on film as fast as he can.

?The unions, with their high labor costs and special rules, have made shooting time more important than quality,? Jonathan remarked. ?Basically, directors are just as fussy about their work as they ever were. They still know how to do a job well. But the cost factor often makes them settle for less.?

Winters also claims that part of a comedian?s survival today is to stay abreast of what is going on, whether it?s straight news, sports, politics, the economy, or whatever it is. He feels a comic?s material has to be as fresh as today?s newspaper or the public doesn?t think he?s with it.

Eventually, Winters probably will go back to work on his autobiography, tentatively entitled: ?I Couldn?t Wait for Success, So I Went on Without It! ?
